Facts:
Following the running of the NEW ZEALAND TROTTING HALL OF FAME TROT an Information Instigating a Protest was lodged by Stipendiary Steward, Mr JM Muirhead against the 5th placing of ITSNOWORNEVER on the grounds that it galloped for the last 15metres of the race and was "lapped on " by BROOKSIDE COLT at the finishing line.
Mrs SH Branch the Trainer of ITSNOWORNEVER endorsed the Information with the words " I do not contest the Protest and do not wish to be present at the Hearing."
Mr Muirhead demonstrated the incident by use of the race films and showed where ITSNOWORNEVER broke approximately 15 metres from the finishing line and was in a break at the line and was "lapped on" by the 6th placed BROOKSIDE COLT.
Submissions for Decision:
Mr Muirhead submitted that ITSNOWORNEVER had been "lapped on" and therefore should be relegated behind BROOKSIDE COLT.
