Facts:
After the running of the CROMBIE LOCKWOOD INSURANCE HANDICAP TROT, an Information instigating a Protest was lodged against the promoted 5th placing of GEORGE on the grounds that it broke during the running and galloped in excess of 150 metres. The Informant was Senior Stipendiary Steward, Mr S Mulcay.
Rule 870(3) requires any horse that breaks during a race to return promptly to its correct gait.
The Breaking Horses Regulations specify that any horse that gallops in excess of 150 metres is in breach of Rule 870(3).
Mr T Macfarlane the Trainer/Driver of GEORGE advised the Committee that the protest was not contested and he endorsed the Information accordingly.
Mr Mulcay demonstrated the incident by use of the race films and showed where GEORGE broke passing the 400 metres mark and galloped well in excess of 150 metres.
Submissions for Decision:
Mr Mulcay submitted that GEORGE was in breach of Rule 870(3) and should be disqualified from the race.
