Facts:
After the running of the CROMBIE LOCKWOOD INSURANCE HANDICAP TROT, an Information Instigating a Protest was lodged by Senior Stipendiary Steward, Mr S Mulcay against the third (promoted to second ) placing of TERESKOVA on the grounds that it broke and galloped in excess of 150 metres in the early stages of the race.
Rule 870(3) provides that any horse that breaks during a race must promptly return to its proper gait.
The Breaking Horses Regulations provide that any horse that breaks and gallops in excess of 150 metres is in breach of Rule 870(3)
Mr P Butcher the Driver of TERESKOVA advised that the Protest was not contested and endorsed the Information accordingly.
Mr Mulcay demonstrated the incident by use of the race films and showed where TERESKOVA broke on the first bend and galloped for well in excess of 150 metres.
Submissions for Decision:
Mr Mulcay submitted that TERESKOVA was in breach of Rule 870(3) and should be disqualified from the race.
