An information was lodged by Stipendiary Steward Mr. J M Muirhead against horseman Mr. M Purdon alleging that Mr. Purdon allowed TARANIA FRANCO to move into the passing lane in the run home.

An information was lodged by Stipendiary Steward Mr. J M Muirhead against horseman Mr. M Purdon alleging that Mr. Purdon allowed TARANIA FRANCO to move into the passing lane in the run home.
--Mr. Purdon admitted the breach of the rule but was present at the hearing.
--Mr. Muirhead demonstrated the incident by showing the video film and showed Mr. Purdon with his horse TARANIA FRANCO in the lead turning for home and the inwards movement at the top of the straight into the passing lane. Mr. Muirhead showed that although Mr. Purdon was clear in the passing lane all the way down the straight, late in the race the horse SUZIE MAGUIRE which had been on the running line had to change course in the straight and missed third place by a nose.
--Mr. Muirhead did however say that it was not alleged that the chances of any other horse was affected.
--Mr. Muirhead said that this was a premier meeting and that the situation could have been worse and he recommended a fine of $500.00.
--Mr. Purdon for his part said that he was clear turning for home and when he tried to pull the hood on his horse it ducked into the passing lane and he had difficulty pulling it out. Mr. Purdon said that his horse was not racing kindly and he was aware that initially it was well clear of the others but it was on one rein and he did have to have an obligation to drive it out. He suggested that he had difficulty in pulling the horse out of the passing lane.
--DECISION
--In considering this matter the committee viewed the films again and could not see that Mr. Purdon had made any great effort to pull the horse out of the passing lane.
--The committee however assessed the evidence as a whole and imposed a fine of $400.00 on Mr. Purdon.
