An information was filed the informant being Mr. T.W.Taumanu  Stipendiary Steward.

The defendant in this instance was Mr J.Lamb  Junior Horseman.

Mr. Lamb was read the rule and indicated he fully understood the rule.

This information alleged a breach of the rules namely rule 868 (2),

This information alleged a breach of the rules namely rule 868 (2), Mr.Taumanu alleged that Mr.J.Lamb driver of the favourite “Holtere” failed to take all reasonable and permissible measures at all times during the race to ensure that his horse was given full opportunity to win the race or obtain the best possible position and/or finishing place.

Mr. Lamb admitted the breach of this rule and was present at the hearing also present was senior horseman Mr G.P.Wolfenden.

Mr Taumanu showed the video of the race and pointed out the relative position of “Holtere” in the running. Mr.Taumanu said   in his evidence it was a very poor drive and more was expected of  a driver.  Mr Taumanu stated that a horseman has an obligation under the rules to put his horse in the race and this was not carried out on this occasion, Mr.Taumanu stated that “Holtere appeared to be pacing well was off the gait at the start and never put into the race at any stage.

Mr.Lamb stated that his horse was shaking his head prior to the start and put some rough strides in that is why he took hold of his horse at the start.

Mr.G.Wolfenden stated that this horse had given his driver some trouble at the trials and could put some rough strides in.

Submissions were made on penalty by Mr.Taumanu who sought a fine of  $750.00 or a suspension  of Mr Lambs, horseman’s  licence of  six weeks.

Mr.Taumanu stated that Mr.Lamb had had 25 drives this season his first as a junior and had to date won two races. 

--

Mr Lamb did not want a suspension of six weeks and Mr.Wolfenden said Mr Lamb was a young man just starting out and did not have a lot of money and should be given credit for his good record.

Decision And Reasons.

--

Having taken into consideration the admittance of this breach of the rules by Mr.Lamb and also his good record to date it is the decision of this Judicial committee to impose a fine of $350.00 and order that Mr. Lambs horseman’s licence be suspended for a period of three weeks up to and including the 11th July 2008 in this instance.

--

Mr. Lamb was reminded of the seriousness of this charge and advised that he must in the future  make every effort to put his horse in the race as per the rules of Harness Racing.
