Facts:
Following the running of Race 7, the Mike Pero Whangaparoa Handicap Trot 2200m Mr Mulcay instigated a protest by way of an Information. He alleged that 'the mare (BEG FOR CHEVRON) broke approaching the 150 metres and galloped in excess of 50 metres.'
Mr Poutama endorsed the Information to the effect that:
(a) He admitted the breach, and
(b) He did not contest the protest and did not wish to be present at the hearing.
Rule 870(3) states that 'Any horse which breaks from its gait shall promptly regain its proper gait'.
The Breaking Horses Regulations (b) provide that:
'Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.'
Submissions for Decision:
Referring to the films of the race Mr Mulcay identified the horse BEG FOR CHEVRON as the field passed the final 200 metres marker. BEG FOR CHEVRON was leading the field when it went off stride into a gallop. The horse continued on in a gallop for approximately 150 metres before finally regaining its gait short of the finish. The horse eventually finished in 5th place. Mr Mulcay submitted that the horse was therefore in breach of the Rules and Regulations and should be disqualified from the race.

It was clear to the Committee that BEG FOR CHEVRON had been off stride for at least 150 metres in the final straight before finally finishing 5th when it had regained its proper gait.
