Facts:

An Information was lodged by Stipendiary Steward Mr N Ydgren against Licensed Trainer Mr B Purdon alleging that Mr Purdon presented THE HAYNE TRAIN into the Assembly Area without the notified Blinds.

Mr Purdon was represented by Stable Horseman Mr Z Butcher and he advised the Committee that the breach was admitted.

Submissions for Penalty:

Mr Ydgren advised the Committee that Mr Purdon had 5 breaches of this Rule in the last 12 months. He further advised that there had not been any breaches in the last 6 months and that Mr Purdon has raced numerous horses in that time.

He submitted that credit should be given for the last 6 months and that any fine should not be greater than the last one which was $125.00.

Mr Butcher explained that the Stable had had a busy night and had 3 horses in Race 7. He explained the Stable's gear procedure and said that it was a genuine mistake. He submitted that credit should be given for the Stable's good record over the last 6 months.

Reasons for Penalty:

The Committee is aware that Mr Purdon has many runners over the season and has heard that the Stable has a procedure for making sure that the horses have the correct gear. The Committee accepts that this breach is the result of a genuine mistake and notes that Mr Purdon has had a good record over the last 6 months.
