An information lodged by Stipendiary Steward Mr J Muirhead against Junior Driver Mr M White, driver of SUPREME ROCKET alleging a breach of the above rule ? Careless Driving, in that he drove his horse carelessly over the latter stages of the race when his horse struck the wheel of MYSTICAL SANDS and broke.
--Mr White admitted the breach and was present at the hearing assisted by Senior Horseman Mr A Butt. Mr Muirhead demonstrated the incident by use of the video film. LE SPOT was weakening quickly and SUPREME ROCKET was improving immediately behind it, requiring Mr White to take evasive action. MYSTICAL SANDS driven by Ms N Chilcott was on the outside of SUPREME ROCKET and when Mr White moved his horse outwards there was insufficient clear room resulting in SUPREME ROCKET striking the sulky wheel of MYSTICAL SANDS and then breaking.
--PENALTY
--Mr Muirhead said the offending was at the lower end of the scale, that Mr White's driving record wasn?t good, however, despite this being a premier night, he recommended a fine of $250.00. Mr Butt said that the sun was glaring in Mr White's eyes, the offending had no bearing on the result of the race, the offending was at the lower end of the scale and Mr White had pleaded guilty.
--In fixing penalty the Committee took into account the following matters :

- The guilty plea. --
- The submissions of Mr Muirhead. --
- The submissions of Mr Butt. --
- Mr White's driving record ? three relevant breaches in the last 12 months. --
- The offending was at the lower end of the scale. --
- The two important mitigating factors ? namely that LE SPOT was weakening quickly and that the sun was glaring into Mr White's eyes.
Balancing all of those matters, the committee imposed a fine of $250.00
