Facts:

An Information was lodged by Stipendiary Steward, Mr NG McIntyre, against Licensed Amateur Horseman, Mr J Brownlee, alleging that Mr Brownlee drove carelessly when shifting ground outwards, approximately 350 metres from home, causing interference to SPEEDSTAR, HOT WIRED and FIREINTHEHOLE.

Mr Brownlee was present at the Hearing and he advised this Committee that he admitted the breach.

Rule 869(3)(b) provides:

“No horseman in any race shall drive carelessly.”

Submissions for Decision:

The parties agreed that the evidence used in the Protest Hearing could be used in this Hearing.

Submissions for Penalty:

Mr McIntyre said that the JCA Guidelines provide a starting point penalty of a $500 fine or suspension of license for 10 drives. He said that Mr Brownlee should be given credit for his admission of the breach and his good record, but he did advise the Committee that at least two horses had suffered interference as a result of Mr Brownlee’s actions. He submitted that a fine of $400 was appropriate.

Mr Brownlee, for his part, said that he would learn from the incident and that he would rely on any leniency given by the Committee.

Reasons for Penalty:

The films in evidence showed that Mr Brownlee had clearly caused interference to at least two other horses in the race. This interference had caused the relegation of his horse but he had also affected the chances of other horses in the race.

Mr Brownlee is an amateur horseman and he has admitted the breach and these factors are taken into account.
