An Information lodged by Stipendiary Steward Mr J Muirhead against Mr I Brownlee, driver of EN SEGUIDA alleging a breach of Rule 857(7)(d), in that he started the race from the incorrect barrier position. Mr Brownlee admitted the breach and did not wish to be present at the hearing.
--Mr Muirhead demonstrated the incident by use of the video film. EN SEGUIDA drew barrier position one on the second row but Mr Brownlee thought it had drawn barrier position two. He did not hear the starter calling out the barrier positions and when the horses moved up behind the mobile barrier Mr Brownlee found that barrier position two was already taken up. He then forced his horse between the horses drawn two and three, forcing the horse which was in the number two barrier position LEGAL OMEN, driven by Mr M White, down into the number one barrier position.
--Penalty:
--Mr Muirhead recommended a fine of $200. He said Mr Brownlee had no relevant breaches of the rules recorded against him.
--In imposing penalty the committee took into account the guilty plea and the clear driving record and the submission of Mr Muirhead, and imposed a fine of $200.
