Following Race 1 an information was lodged by Stipendiary Steward Mr J. Muirhead against Mr C. Rutherford driver of RITHCHIE BRYDON alleging a breach of Rule869(2)(a) in that he used his whip excessively over the concluding stages of the race.

--Mr Rutherford admitted the breach and was present for the hearing.

Stipendiary Steward Mr J. Muirhead showed the video film of the last 300 metres of the race. He stated that Mr Rutherford had hit his horse 21 times over the concluding stages.
Mr Rutherford stated he understood the Rule, but continued to drive his horse along as it was making up some ground, the official placing was 6th.

Mr Muirhead said Mr Rutherford has no relevant breaches of the rules recorded against him. He saw the offending as being mid range. He said the recommended starting point was a fine of $250.00 or a suspension for one week. In fixing penalty the committee takes into account the following matters:
1. The guilty plea.
2. Mr Rutherford’s clear driving record.
3. The recommended starting point for penalty.
4. The offending being mid range.
5. The submissions of Mr Muirhead.
Balancing those matters, a fine of $200.00 is imposed on this occasion.
