Following Race 2 an information was lodged by Stipendiary Steward Mr J. Muirhead pursuant to Rule 857(7) (g). He alleged that horseman Mr S Argue failed to come up into barrier position 8 with AMBRASHIA at the start.



Following Race 2 an information was lodged by Stipendiary Steward Mr J. Muirhead pursuant to Rule 857(7) (g). He alleged that horseman Mr S Argue failed to come up into barrier position 8 with AMBRASHIA at the start.

Mr Argue did not admit the breach and was present during the hearing.

Stipendiary Steward Mr Muirhead demonstrated the video films which clearly showed Mr Argue 2 length off the mobile barrier at the dispatch point. He stated Mr Argue made no attempt to get his horse onto the mobile barrier.

Mr Argue stated he was chirping at his horse to move up to the mobile but she was looking at the signs on the outside fence. He said at no stage did he hear the starter call him to move up.

Stipendiary Steward Mr Taumanu was called to give evidence and he said from the patrol box at the top of the home straight he heard the starter call out to Mr Argue 3 times, he stated that Mr Argue was 3 lengths behind the mobile and he thought the driver would have made a bigger effort to move up to the mobile.

The video clearly showed Mr Argue had failed to come up into his correct barrier position; he had visibly made no attempt .The charge is proven.

Penalty

--

Mr Muirhead said the recommended fine was $250.00, Mr Argue had a clear record under this rule.

The recommended starting point in the penalty guide of a $250.00 fine is imposed.
