The breach is admitted and therefore the charge is proved.

Penalty:

The Committee imposes a fine of $200.00 on Mr Purdon.

Facts:

Following the running of the POWELL TRANSPORT MOBILE PACE an Information was lodged by Stipendiary Steward Mr JM Muirhead against Licenced Horseman Mr B Purdon alleging that Mr Purdon when driving ATOMIC BETTY failed to come up into and/or maintain his barrier position one on the second line behind the mobile gate at the start of the race.

Mr Purdon advised this Committee that he admitted the breach and he did not want to be present at the Hearing.

The rule requires all drivers to come up into and/or maintain their positions at the start of a race.

Mr Muirhead demonstrated the incident by use of the race films and he showed where Mr Purdon was several lengths behind the mobile barrier as it was coming up to the starting point. Mr Purdon did not appear to be making any effort to keep his horse up in position and after the start it was noticeable that he was able to move one out and chase his horse up and it responded.

Submissions for Penalty:

Mr Muirhead  said that Mr Purdon had admitted the breach and has a good record and should be given credit for this. He left the Committee to decide on penalty.

Reasons for Penalty:

The race films clearly show the incident and it is as described by Mr Muirhead in his evidence. The Committee notes the mitigating factors advised by Mr Muirhead.

The Committee records that the JCA Guidelines provide for a starting point penalty of suspension of Licence for 5 drives or a $250.00 fine. The Committee has also checked its JCA Penalty Schedules for penalties for the same offence.

Taking all factors into account the Committee is going to deal with this by way of fine and $200.00 in our view is an appropriate figure.
