Facts:
This is an uncontested protest arising from the running of race 7, the SMART CHOICE MOBILE PACE 2200m. Ms Kinsey, Stipendiary Steward, alleged that the 3rd placed horse HUGHIE GREEN broke in excess of 150 metres approaching the 1600 metres.
The relevant rules and regulations include:
R 870(3) - Any horse which breaks from its gait shall promptly regain its proper gait.
R 870(4) - Any horse which breaks from its gait in any race and (a) which fails to promptly regain its proper gait may (in addition to any other penalty imposed pursuant to Rule 1003 hereof) subject to the provisions of the Breaking Horse Regulations made by the Board, be placed by the Judicial Committee immediately after any other horse in respect of which any advantage may have been gained.
The Breaking Horse Regulations provide:
(a) Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.
The Judge’s placings were:
1st – No 6 LETS ELOPE
2nd – No 5 NORVIC NIGHTOWL
3rd – No 2 HUGHIE GREEN
4TH – No 4 IMAJOLLYWALLY
5TH – No 3 BRYDON DELIGHT
The margins were ½ L, 7 ¾L, 2 ½ L.
Mr B Hughes, the Trainer of HUGHIE GREEN did not attend the hearing and he endorsed the Information “I do not contest”.

Ms Kinsley demonstrated the incident using head and side on video film. She identified HUGHIE GREEN who was in the lead nearing the 1600 metre mark. She said HUGHIE GREEN paced roughly then broke for approximately 250 metres and then regained its gait, settled at the rear of the field and finished the race off strongly into 3rd place.
Reasons for Decision:
HUGHIE GREEN clearly broke and galloped for between 240 and 260 metres and therefore is in breach of the Breaking Horses Regulations and rule 870(3) in that he broke for a distance greater than 150 metres and failed to promptly regain his proper gait within the allowed distance.
