DECISION & REASONS

--

An information lodged by Stipendiary Steward, Mr J Muirhead, against Mr S Reid, driver of WASHAKIE, alleging a breach of Rule 869(2)(a) and (c) ? excessive use of the whip ? Drawing whip further back than the sulky seat, when driving WASHAKIE out over the concluding stages of the race.

--

Mr Reid admitted the breaches and was present at the hearing.

--

Mr Muirhead demonstrated the incident by use of the video film. Mr Reid hit his horse about 16 times in the run home and on a number of occasions his whip was drawn further back than the sulky seat. WASHAKIE finish third, the margins being a nose and half a head. Mr Muirhead said that Mr Reid had an excellent driving record as far as his use of the whip was concerned, saying he ?usually takes pride? in his use of the whip.

--

Mr Reid said he was disappointed in himself, that he was a big man and did not have a lot of leeway in the sulky and that he had got a bit carried away.

--

Penalty:

--

Mr Muirhead suggested the minimum standard fine of $250. Mr Reid in essence asked for the lowest possible fine.

--

In fixing penalty the committee took into account the following matters:

--
    --
  1. The guilty plea.
  2. --

--
