DECISION & REASONS
--An information lodged by Stipendiary Steward, Mr J Muirhead, against Mr F Cooney, driver of MOUNTAIN WOMAN alleging a breach of Rules 869(4)(6)(b)& (c) ? causing interference and push-out ? in that he forced GEORGE CASTLETON driven by Mr W Taylor to race wider on the track with approximately 1800m to run.
--Mr Cooney admitted the breach and was present at the hearing.
--Mr Muirhead demonstrated the incident by use of the video film. Mr Cooney moved his horse outwards whilst GEORGE CASTLETON was improving on its outside forcing that horse to cover a slight amount of extra ground. Mr Muirhead said that GEORGE CASTLETON was improving quickly and Mr Cooney had misjudged the situation.
--Penalty:
--Mr Muirhead recommended a fine of $200. He said Mr Cooney had no relevant breaches of the rules recorded against him. Mr Cooney said he accepted Mr Muirhead's submissions.
--In fixing penalty, the Committee took into account the following:

- The guilty plea. --
- Mr Cooney's clear driving record. --
- The submissions of Mr Muirhead. --
- Mr Cooney's acceptance of those submissions. --
- The offending was at the lower end of the scale ? the committee accepted it was simply a misjudgement.
The committee imposed a fine of $200.
