An information lodged by Stipendiary Steward, Mr J Muirhead, against Mr F Cooney, driver of MOUNTAIN WOMAN alleging a breach of Rules 869(4)(6)(b)& (c) ? causing interference and push-out ? in that he forced GEORGE CASTLETON driven by Mr W Taylor to race wider on the track with approximately 1800m to run.

Mr Cooney admitted the breach and was present at the hearing.

Mr Muirhead demonstrated the incident by use of the video film. Mr Cooney moved his horse outwards whilst GEORGE CASTLETON was improving on its outside forcing that horse to cover a slight amount of extra ground. Mr Muirhead said that GEORGE CASTLETON was improving quickly and Mr Cooney had misjudged the situation.

Penalty:

Mr Muirhead recommended a fine of $200. He said Mr Cooney had no relevant breaches of the rules recorded against him. Mr Cooney said he accepted Mr Muirhead's submissions.

In fixing penalty, the Committee took into account the following:

  3. Mr Cooney's clear driving record.
  4. --
  5. The submissions of Mr Muirhead.
  6. --
  7. Mr Cooney's acceptance of those submissions.
  8. --
  9. The offending was at the lower end of the scale ? the committee accepted it was simply a misjudgement.
