| -- An information was lodged by Stipendiary Steward Mr. T W Taumanu against Mr. T MacFarlane the driver of Waiheke Magic in race no 11. --The information alleged a breach of rule 869 (2) (c), by Mr. McFarlane and the information stated that Mr T MacFarlane used his whip outside the confines of his sulky during the run home. --Mr. MacFarlane admitted the breach and was present at the hearing of this information. --Mr. Taumanu showed the run home on the video and this showed Waiheke Magic running on under a drive by Mr. Macfarlane and Mr. Macfarlane's whip clearly outside the confines of his sulky. Mr. Taumanu presented submissions on penalty as did Mr. MacFarlane, Mr. Taumanu advised that he viewed this breach at the lower end of the scale. Mr. MacFarlane when questioned stated he was aware of the whip guidelines as issued by HRNZ. --Decision and Reasons. --This Judicial committee having taken into consideration the admission of this breach by Mr. MacFarlane imposed a fine of $175.00 on this occasion and advised Mr. Macfarlane to change his action with his whip in future. --Chairman -- -- --
