An information was lodged by Stipendiary Steward Mr. J M Muirhead alleging a breach of rule 869 (2) (a) Excessive use of the whip. The information stated that horseman Mr. C Thornley used his whip excessively over the concluding stages

An information was lodged by Stipendiary Steward Mr. J M Muirhead alleging a breach of rule 869 (2) (a) Excessive use of the whip. The information stated that horseman Mr. C Thornley used his whip excessively over the concluding stages when driving out Ruthless Jenny.

Mr. Thornley admitted the breach and was present at the hearing of this information.

Mr. Muirhead showed the video of the run home and this confirmed that Ruthless Jenny was under a hard drive by Mr. Thornley with this horse being struck with the whip many times with out a break from the top of the straight to the winning post. Ruthless Jenny won this race.

Mr. Thornley stated that this was the first time he had used the whip on Ruthless Jenny and he acknowledged it, "looked real bad" on the video. Mr. Muirhead stated stipendiary control expected more from a driver of Mr. Thornley's standing and Mr. Thornley stated that it wouldn?t happen again. Mr. Thornley acknowledged he was aware of the guidelines as set down by HRNZ on the use of the whip when questioned by the chairman.

Submission were heard from both Mr. Muirhead and Mr. Thornley on penalty Mr. Muirhead presented the driving record of Mr. Thornley for perusal this showed a clear driving record over the last twelve months.

Decision and Reasons.

This Judicial Committee having taken into account the frank admission of the breach of this rule by Mr. Thornley and also his excellent driving record imposed a fine of $300.00 in this instance.

The committee also advised Mr. Thornley that using a whip in this manner is unacceptable and will not be tolerated.
