The Protest is upheld and SIR HENRY CASTLETON is disqualified from the race.

The amended placings are now:   first (4) MASSIVE METRO

                                                    second (5) SEX ON FIRE

                                                    third (8) SWINGING

                                                    fourth (1) ANZAC

It was ordered that stakes be paid in accordance with the amended placings.

Facts:

Following the running of the NRM HANDICAP TROT an Information was lodged by Senior Stipendiary Steward Mr JM Muirhead against the promoted 5th placing of SIR HENRY CASTLETON on the grounds that it broke in the final 200 metres of the race and galloped in excess of 50 metres.

Rule 870(3) provides: any horse which breaks from its gait shall promptly regain its proper gait.

Part B of the Breaking Horses Regulations provides: any horse which breaks from its gait in the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.

Mr W Taylor the part Owner and Trainer of SIR HENRY CASTLETON advised the Committee that the Protest was not contested. Mr Taylor did not wish to be present at the Hearing.

Mr Muirhead demonstrated the incident by use of the race films and showed where SIR HENRY CASTLETON broke in the home straight and galloped almost 100 metres.

Submissions for Decision:

Mr Muirhead submitted that because SIR HENRY CASTLETON had galloped in excess of 50 metres in the last 200 metres of the race it should be disqualified from the race.
