Facts:
An Information was lodged by Stipendiary Steward, Mr B J Van Kan, against Licensed Trainers, Mr & Mrs D & C Butt, alleging that they presented STINGRAY without the notified removable deafeners.
Mr Butt admitted the breach and advised this Committee that he did not wish to be present at the Hearing.
Submissions for Penalty:
Mr Van Kan submitted that a fine of $150 was appropriate. He referred to previous breaches of this Rule by Mr & Mrs Butt.
Reasons for Penalty:
The penalty for an offence under this Rule under the Minor Infringement system, is $100. The D & C Butt Training Partnership however, have had three breaches of this Rule in the last twelve months, and it is for this reason, that this matter has been brought before the Committee, and that Mr Van Kan has submitted a fine of $150. The Committee believes that this is appropriate.
