The Protest was upheld and the official placings became:

Authority was given for stakemoney to paid in accordance with the above placings.

Facts:

Following the running of race 3. the Cancer Society Auckland Northland and Mobile Trot 2200m, an Information instigating a protest was lodged by Mr Mulcay, alleging that BLOOD AND WHISKEY galloped in excess of 150m during the running of the race.

Ms S Wallis, co-trainer of the horse, did not appear at the hearing, however had noted on the Information that the protest was not contested.

The Breaking Horses Regulations (a) provide that:

Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150m or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.

Rule 870(3) provides 'Any horse which breaks from its gait shall promptly regain its proper gait.'

After an earlier Protest hearing applicable to this race the Placings, as determined by the Committee were:

1st       IZINTHEZONE

2nd      THE CROWN JEWELLS

3rd       MORTICIAN

4th       OUR ROSA

5th       BLOOD AND WHISKEY

6th       SAINT MICHEL

Submissions for Decision:

Mr Mulcay used the available films to demonstrate that BLOOD AND WHISKEY had gone off stride at about the 800m mark, and had galloped for considerably more than 150m before finally regaining its stride.

This was not contested by the connections of the horse.  Mr Mulcay therefore submitted that the horse BLOOD AND WHISKEY should be disqualified from the race. There was prizemoney applicable to 5th placing in this race.

Reasons for Decision:

As the Protest was not contested the Committee upheld it.
