EVIDENCE:

Information No. A12962 was filed with the Judicial Committee. It was alleged that Mrs Teaz used her whip on more occasions than is permitted under Clause (b) of the Whip Regulations, when driving MAJESTIC HARRY over the final 400m of Race 3 (Garrards Horse & Hound Pukekohe Trot).

The hearing was adjourned and reconvened on 23 July 2020 at the Cambridge Raceway.

Mrs Teaz acknowledged that she understood the Rule, the Charge and confirmed that the breach was admitted.

Mr Muirhead showed the film replay and showed where Mrs Teaz had hit her horse 11 times from inside the 400m.

Mrs Teaz agreed with the Stipendiary Steward’s assessment of her whip use and added that she had become a little excited and that it was only one strike more than the Whip Regulation allows.

(Whip Regulation states 10 strikes only)

DECISION:

Due to the charge being admitted it was found proved by the Committee.

PENALTY SUBMISSIONS:

Mr Muirhead said that Mrs Teaz had a clear record and that there were no aggravating factors to consider.

Mrs Teaz had nothing more to say.

REASONS FOR PENALTY:

The Committee considered that the whip use of 11 strikes, 1 over the limit of 10. As there were no aggravating factors to consider, the JCA Penalty Guide starting point of $200 was considered appropriate.

PENALTY:

Mrs Teaz was fined $200.
