Facts:
Following the running of Race 7 an Information Instigating a Protest was lodged by Stipendiary Stewart Mr JM Muirhead against the third placing of horse number 6 SIR LINCOLN on the grounds of causing interference at the start of the race to horse number 8 PEMBROOK BENNY.
Mr MW McKendry the Driver of SIR LINCOLN advised this Committee that he was representing the connections of the horse and he endorsed the Information with the words “I do not contest the Protest”.

Mr Muirhead demonstrated the incident by use of video films and these quite clearly showed SIR LINCOLN breaking at the start and continuing in a break and running inwards and coming into contact with PEMBROOK BENNY and causing that horse to break and loose a considerable amount of ground. SIR LINCOLN started from the 10 metre mark and PEMBROOK BENNY from the 20 metre mark.
Reasons for Decision:
The Protest is not contested and the incident is quite clearly shown on the video films.
