The Committee relegates YOGI JOHNSON from 3rd to 4th and as a result IL PIRATA is promoted to 3rd.

Amended placings are:

The Committee orders that Stakes and dividends are to be paid in accordance with the amended placings.

Facts:

Following the running of the HUTTON RACING STABLES SIRES STAKES MOBILE TROT an Information instigating a Protest was lodged by Stipendiary Steward Mr JM Muirhead against the 3rd placing of YOGI JOHNSON on the grounds of galloping excessively from approximately the 800 metres mark.

Mr Johnson and Ms Wallis were present at the Hearing and they advised the Committee that the Protest was contested.

The Breaking Horse Regulations provide that if a horse breaks and gallops in excess of 200 metres during the Race then it shall be in breach of Rule 870(3).

Judge’s placings were:

1st

 – No 4 TOUT NOIR

2nd

 – No 2 CYBERSPACE

3rd

 – No 1 YOGI JOHNSON

4th

 – No 5 IL PIRATA

The official margins were 16L, 10L and 40L.

Submissions for Decision:

Mr Muirhead demonstrated the incident using all available Race films. He identified YOGI JOHNSON driven by T Herlihy in front approaching the 800 metre mark. He advised the Committee that YOGI JOHNSON broke and galloped for approximately 170 to 180 metres. He demonstrated this distance using the markers as a measure.

After viewing the video footage the connections of YOGI JOHNSON advised the Committee they no longer contested the Protest.

Mr Muirhead sought  relegation of YOGI JOHNSON rather than disqualification in accordance with the Breaking Horse Regulations and also because of the special circumstances of the Race.

Reasons for Decision:

Due to the Protest now being uncontested it is upheld.
