The Protest having not been contested is accordingly upheld and Number 6 ITSNOWORNEVER is disqualified from the Race.

Facts:
An Information Instigating a Protest was lodged by Stipendiary Steward Mr JM Muirhead against the 5th placing of ITSNOWORNEVER on the grounds of breaking from its gait and galloping approximately 160 metres over the concluding stages of the Race.
Mrs SH Branch the Trainer of ITSNOWORNEVER endorsed the Information with the words " I do not contest the protest".
Stipendiary Steward Ms P Kinsey demonstrated the incident by use of the films of the Race. She showed where ITSNOWORNEVER broke early in the run home and galloped for about 190 metres.
Submissions for Decision:
Ms Kinsey submitted that ITSNOWORNEVER had galloped in excess of 50 metres in the run home and was therefore in breach of the Breaking Horse Regulations and accordingly should be disqualified from the Race.
