This is an information filed by Stipendiary Steward Mr J MUIRHEAD against Ms N MOLANDER driver of SECRET POTION alleging a breach of the above rules in that she allowed her horse to make contact with and run over six pylons during the run home.

This is an information filed by Stipendiary Steward Mr J MUIRHEAD against Ms N MOLANDER driver of SECRET POTION alleging a breach of the above rules in that she allowed her horse to make contact with and run over six pylons during the run home. 

Ms MOLANDER admitted the breach and was present at the hearing. 

Mr MUIRHEAD showed the video film of the incident.  SECRET POTION was three back on the marker pegs entering the home straight, trailing GOMEO ROMEO.  GOMEO ROMEO moved into the passing lane.  Ms MOLANDER moved SECRET POTION into the passing lane and tried to improve on the inside of GOMEO ROMEO where there was insufficient room.  Ms MOLANDER’s sulky wheel made contact with and went inside six track markers. 

Ms MOLANDER said her horse was travelling well and she wanted to improve her position.  She said sometimes you can and sometimes you can’t go where she went.  She said it was the Derby and she had no where else to go. 

PENALTY

Mr MUIRHEAD said the recommended starting point was a fine of $200, Ms MOLANDER had no relevant breaches of the rules recorded against her and this was a group one race.  He recommended a fine of $200. 

Ms MOLANDER said she didn’t think the breach was all that serious as she was only trying to improve her position and did not affect any other horses. 

In fixing penalty the committee takes into account the guilty plea, the submissions of Mr MUIRHEAD and Ms MOLANDER, the recommended starting point, the offending is about mid-point on the scale of seriousness, Ms MOLANDER’s clear driving record and the fact that this is a group one race. 

Balancing those matters, but with emphasis on the submission of Ms MOLANDER that she was in effect desperately trying to improve the chances of her horse and did not affect the chances of any other horse, a fine of $250 is imposed.
