An information filed by Stipendiary Steward Mr J. Muirhead against Mr J. Wheeler, trainer of YANKEE NOVA alleging a breach of the above rule in that he failed to ensure that the removable earhood used on the horse was of good order and condition.

--Mr Wheeler admitted the breach and was present at the hearing.
--Mr Muirhead said the starter’s assistants had found that the earhood had come adrift prior to the start of the race and could not be re-fixed. The Velcro strap would not stay in position. The earhood was removed before the start and later examination showed that there was some wear. Mr Wheeler said he did not have any trouble in placing the earhood on the horse and felt that some mud or other object has caused the problem.
--Mr Muirhead said Mr Wheeler had no relevant breaches of the rules recorded against him.
--The recommended starting point penalty of $175.00 is imposed.
