An information was lodged by Assistant Stipendary Steward B J VanKan against Mr Balle trainer of CLASS OPERATIVE alleging a breach of rule 865(4) in that the horse was presented in the assembly area without a removable ear hood despite the fact that it had raced with a removable ear hood at the Auckland Trotting Club Meeting on 5th August 2005.

An information was lodged by Assistant Stipendary Steward B J VanKan against Mr Balle trainer of CLASS OPERATIVE alleging a breach of rule 865(4) in that the horse was presented in the assembly area without a removable ear hood despite the fact that it had raced with a removable ear hood at the Auckland Trotting Club Meeting on 5th August 2005. Mr Balle admitted the charge and was present at the hearing.

Mr VanKan confirmed that he was checking the horses when they entered the assembly area and he noted that CLASS OPERATIVE was not wearing a removable ear hood. Mr VanKan was aware that it had raced in a removable ear hood on the 5th August 2005 and drew this to Mr Balle's attention. The horse was returned to the stables to have the removable ear hood added.

Mr Balle admitted the facts but stated that he had two horses in the race and that his stable hand had geared up CLASS OPERATIVE and thought that the horse had not worn a removable ear hood the previous week. Mr Balle acknowledged that he had left the stable hand to gear up the horse and had not checked the gear properly because he was busy with his other horse but he readily acknowledged that it was his responsibility.

The breach having been admitted, Mr VanKan proposed a fine of $100.00. Mr Balle submitted that this was a minor matter and any penalty should be considerably less then $100.00.

In imposing penalty the Committee took into account the following matters:

1. The facts as presented to the Committee and the submissions made.

--

2. Mr Balle's frankness in admitting the breach and facts.

--

3. The fact that Mr VanKan was alert when the horses were in the assembly area and accordingly the horse did not race with incorrect gear.

--

4. The rule exists for the benefit of the public.

--

--

Having taken into account all of the above matters the Committee imposed a fine of $75.00
