An information was lodged by Stipendary Steward Mr J Muirhead against Mr J Stables trainer of COVERED SUPREME alleging a breach of rule 858(a)(b) in that he was late presenting the horse in the assembly area so that it went onto the track at nine minutes prior to race start time.

Mr Stables admitted the charge and was present at the hearing. ----Mr Muirhead confirmed the facts to the Committee in that COVERED SUPREME was late into the assembly area and as a result was on the track nine minutes prior to start time. ----Mr Stables admitted the facts and acknowledged that he was aware of the requirement to have his horse in the assembly area at least twelve minutes prior to start time and the requirement for the horse to be on the track ten minutes prior to start time. ----Mr Stables stated that he was not wearing a watch and that he did not hear the call for horses to be taken to the assembly area. He stated that he finished getting his horse ready when he saw a fellow trainer doing the same but he acknowledged that he was still late in the assembly area and did not have any real excuse for that. ----Mr Muirhead proposed the standard fine of $100.00 be imposed. ----In imposing penalty the Committee took in to account the following matters: ----1. The facts as set out above and the submissions made. ----2. The frankness displayed by Mr Stables in admitting the breach. ----3. Mr Stables' good record. --------4. The rule exists both for the proper running of a race meeting and for the convenience of the public. ----Taking all the above matters into account the Committee imposed a fine of $75.00. ------ --
