Mr Hall has used his whip excessively whilst driving THEMIGHTYQUINN throughout the course of the run home.
Facts:
Mr Muirhead showed the video film of the run down the home straight. He showed that Mr Hall used his whip on about 23 occasions. He said that was an excessive number.
Mr Hall said he was caught up in the emotion, the strikes were “minimal”, he did not raise his upper arm and only used his wrist and elbow. He said THEMIGHTYQUINN went past MR FEELGOOD and then began to stop – he got desperate and then used the whip.
The committee pointed out to Mr Hall that he had used his whip continuously early in the home straight in breach of the “use of the whip guidelines”.
Mr Hall acknowledged that was so.
Submissions for Penalty:
Mr Muirhead said Mr Hall had no relevant breaches of the rules on his record, the recommended starting point was a fine of $250 or one week’s suspension and the offending was in the upper range on the scale of seriousness. He said the Group One status of the race should be taken into account – rule 1114 (2)(a). He submitted that a fine of $500 should be imposed.
Mr Hall said he had not used excessive force, the emotions were getting to him and in effect he requested that the usual fine, whatever that was, be imposed.

In fixing penalty the committee takes into account the admission of the breach, the submissions of Mr Muirhead and Mr Hall, the clear record of Mr Hall, the recommended starting point, penalties imposed in previous cases in major races, rule 1114 (2)(a) and our view that the offending is mid range.
