Following the running of Race 5 an information was filed, the Informant being Mr T.W. Taumanu - Stipendiary Steward, the Defendant Mr B. Healy trainer of SUMTHINGABOUTMAORI. The information alleged that Trainer B. Healy (SUMTHINGABOUTMAORI) failed to use the same gear on his horse as was used on Tuesday 8th March 2005, namely the undercheck.
| ---- Following the running of Race 5 an information was filed, the Informant being Mr T.W. Taumanu - Stipendiary Steward, the Defendant Mr B. Healy trainer of SUMTHINGABOUTMAORI. The information alleged that Trainer B. Healy (SUMTHINGABOUTMAORI) failed to use the same gear on his horse as was used on Tuesday 8th March 2005, namely the undercheck. This breach was admitted by Mr Healy and he did not wish to be present at the hearing. Mr Taumanu outlined the basis of his case in that the Stipendiary Stewards did not receive a request to leave this gear off and no contact was made with Stipendiary Control about this gear being left off SUMTHINGABOUTMAORI. ----DECISION AND REASONS: --The Judicial Committee having taken into account Mr Healy's admission of the breach and also taking into account the status of the race and the provisions of Rule 1114 imposed a penalty of $200.00 in this instance. --
