Under Rule 869 (4) and (8) an information instigating a protest was filed by Stipendiary Steward Mr J Muirhead on behalf of DWIGHT, driven by Mr P Ferguson, placed 6th, against HE'S AWESOME, driven by Ms N Chilcott, placed 2nd,on the grounds of interference close to the finish of the race

Ms Chilcott and part owner Mr S Dunlop represented the connections of HE'S AWESOME.
--Mr Muirhead demonstrated the incident by use of the video film. He said HE'S AWESOME ducked out about 24m from the finish. DWIGHT was in 4th position at that time and holding that position. The interference affected the chance of DWIGHT finishing 4th which is a stake bearing position.
--Mr Ferguson said he was clearly holding 4th and would have finished 4th but for the interference.
--Ms Chilcott said DWIGHT was stopping and the horses which were placed 4th and 5th were making ground quickly. She said it was not possible to be sure that DWIGHT would have finished 4th. She thought the other two horses TURISMO and ATOMIC MOTORING may well both have beaten DWIGHT.
--Mr Dunlop said DWIGHT would never have finished 4th and Mr Ferguson did not take hold of the horse. The margins were three quarters of a length, a head, one and a quarter lengths, .3 of a length and .4 of a length.
--DECISION AND REASONS :
HE'S AWESOME did cause interference to DWIGHT. DWIGHT was in 4th position at that time but TURISMO and ATOMIC MOTORING were both finishing quickly. There is a conflict of evidence as to whether or not DWIGHT would have finished 4th which is a stake bearing position. The photo of the finish shows that DWIGHT was three quarters of a length from the 4th horse at the finish of the race. The evidence and my own observations of the video film leave me in a state of doubt as to whether or not DWIGHT would have finished 4th and the protest is therefore dismissed.
