Following the running of race No 1, information was filed alleging a breach of Rule 869(3)(b). The informant was Mr. J M Muirhead Stipendiary Steward, the defendant was Mr. I Brownlee the driver of Shezaclassact in race no 1.

Following the running of race No 1, information was filed alleging a breach of the rules the informant was Mr. J M Muirhead Stipendiary Steward, the defendant was Mr. I Brownlee the driver of Shezaclassact in race no 1.
--Mr. Brownlee was present at the hearing of this information, and admitted the breach of this rule.
--The information stated that Mr. I Brownlee the driver of Shezaclassact drove carelessly when contesting a position with "It's O K Flyin" (Mr. M White) causing his own horse to break racing into the first bend.
--Mr. Muirhead showed the video of this incident to the committee and it was clear to see that Mr. Brownlee had been attempting to force "It's O K Flyin" down to the pole line and as a result of the pressure Mr. Brownlee's drive Shezaclassact had broken stride and drifted out.
--Mr. Muirhead stated that Mr. Brownlee was a competitive driver and to his credit he had admitted the breach of this rule. Mr. Muirhead also stated to the committee that no other horse had been interfered with while Shezaclassact was off stride. Mr. Muirhead stated this breach was at the lower end of the scale.
--Mr. Muirhead made submissions on penalty and asked for a suspension of Mr. Brownlee's horseman's licence for a period of two days.
--Mr. Brownlee made submissions on penalty and also stated he preferred a suspension as opposed to a fine. The driving record of Mr. Brownlee was produced for perusal by the committee.
--Decision And Reasons.
--Having taken into consideration the admission of the breach of this rule by Mr. Brownlee and also the submission's made by Mr. Muirhead this Judicial Committee orders a suspension of Mr. Brownlee's horseman's licence for a period of two days to and including the 24th August 2006.
--Mr. Brownlee was advised by the chairman to exercise more care in the future as his record showed two previous breaches of this rule and that the committee had given him a discount of one day for his frank admission of the breach of this rule.
