An information was filed alleging a breach of rule 867 which states " Every horseman shall drive throughout the race with both feet in the rests of the sulky provided for that purpose".

An information was filed alleging a breach of rule 867 which states " Every horseman shall drive throughout the race with both feet in the rests of the sulky provided for that purpose".
--Mr. Escott alleged that Mr. C. J. DeFilippi the driver of (Pompallier), had dropped his leg from the sulky rest over the concluding stages.
--Mr. DeFilipi admitted the breach of this rule and was present at the hearing.
--Mr. Escott showed the video of the run home and it could be clearly seen that Mr. DeFilipi had his left leg out of the rest all the way up the straight to the winning post.
--Mr Escott advised the Judicial Committee that this was Mr. De Fillipi's third charge under this rule recently.
--Mr. DeFilppi stated to the committee that he was not using his leg as a bar and only did it so that he could use his whip on Pompallier. Mr. DeFilipi stated Pompallier was a big horse and he could not reach this horse to use his whip unless he dropped his foot from the foot rest.
--Submissions were heard on penalty from both Mr. Escott and Mr. DeFilipi and Mr. DeFilipi's driving record was produced for perusal.
--Decision and Reasons.
--Having taken into consideration the submissions made by Mr. Escott and Mr. DeFilipi and also the frank admission of the breach of this rule by Mr. DeFilipi this Judicial Committee imposed a fine of $300.00 in this instance.
--This was a premier night of racing with the stake for this race being $40,000, and the Judicial Committee advised Mr. DeFilipi that any more breaches of this rule would result in a more severe penalty.
