The incident is shown clearly on the Race films and the Protest is quite correctly not contested. The Committee accordingly upholds the Protest and JOGO BONITO is disqualified from the Race.

The amended placings are now : 1st (6) LOVE YA DOOSIE

                                                 3rd (3) SHOWTIME LADY

                                                 4th (8) A SPECIAL DREAM

                                                 5th (4) DJOKOVIC

The Committee orders that dividends and stakes be paid in accordance with the amended placings.

Facts:

An Information Instigating a Protest was lodged by Stipendiary Steward Mr JM Muirhead against the 5th placing of JOGO BONITO in THE ALEX BAR & EATERY OPEN 7AM 'TIL LATE TROT on the grounds of galloping in excess of 50 metres inside the last 200 metres and therefore failing to regain its gait promptly.

Stipendiary Steward Mr B Jones appeared on behalf of Mr Muirhead and he advised that the Owners of JOGO BONITO did not contest the Protest. The Information was endorsed with the words " I do not contest Protest ".

Mr Jones demonstrated the incident by use of the Race films and showed JOGO BONITO breaking in the home straight and galloping for approximately 70 metres.

Submissions for Decision:

Mr Jones submitted that because JOGO BONITO galloped in excess of 50 metres in the last 200 metres of the Race it should be disqualified.
