An information was filed alleging a breach of 869 (4), (6) (b) & (c). The informant was Mr. J M Muirhead and this protest was against horse number 11 Rosscoe placed 5^th by the judge.

An information was filed alleging a breach of 869 (4), (6) (b) & (c). The informant was Mr. J M Muirhead and this protest was against horse number 11 Rosscoe placed 5^th by the judge. The judges placings for this race were 1^st No 6, 2^nd No 12, 3^rd No 4, 4^th no 3, 5^th No 11, 6^th no 8.

This protest alleged a breach of the Push Out Rule by Rosscoe which was not contested by the connections of this horse. Mr. Milina the driver of Rosscoe signed the information he did not wish to contest the protest, and was not present at the hearing.

Mr. Muirhead showed the video of the alledged breach and this showed Rosscoe coming off the pole line and following Our Sunny Whiz in doing so Rosscoe forced Wee Annie to race wider on the track. Mr. Muirhead sought disqualification of Rosscoe from his 5^th placing.

Having viewed the video of this alleged breach of the push out rule and taken into consideration that this protest was not contested by the connections, this protest is upheld.

This Judicial Committee orders the disqualification of Rosscoe from 5^th place in race 10.

The amended placings for this race shall now read 1^st No 6, 2^nd No 12, 3^rd No 4, 4^th no 3, 5^th no 8, 6^th No 7.
