DECISION & REASONS:
--Information 32024 filed by Jockey G L Cooksley instigated this Protest under Rule 876 (1) of the Rules of Racing following Race 3 alleging that BEAU CASUAL or its rider, Harmony Moki, placed second by the judge interfered with the chances of WAIKEEPADACASH placed fourth. The interference was alleged in the home straight and the margin between second and third was three quarters of a length with a further half a length to the fourth horse.
----Trainer B Pomare represented the connections of BEAU CASUAL and the Trainer of WAIKEEPADACASH, Mr R Yuill, was present with one of its owners, Mr P Walker. Also present were riders G L Cooksley and Harmony Moki. Chief Stipendiary Steward C George was also present.
----Mr Cooksley explained that he had commenced a run outside Harmony Moki at about the 150 metre mark. He also demonstrated the incident on video and after identifying the runners he showed that as he attempted to improve Miss Moki had come out three or four horses and taken his line of running causing a check and loss of momentum. Even though he had recovered and started to regain ground lost, which he estimated to be about two lengths, he could only recover to be a half-length from the third horse at the finish. He felt his chances were definitely affected and thought he might otherwise have been second or third.
----Mr Pomare said, from looking at the video, he believed Mr Cooksley had not had to stop riding at any stage, or not as much as he claimed. However, he agreed there had been an outward movement as alleged. Miss Moki confirmed his interpretation and said she believed it had not been as severe as suggested by Mr Cooksley but she conceded that the outward movement had occurred.
----Mr. George told the committee he believed there had been an outward movement by Miss Moki, which had resulted in interference to Mr Cooksley and this, had possibly cost him third place.
----After considering the above and the video the Committee is satisfied that interference has occurred by BEAU CASUAL as alleged and the issue which remains is whether that interference has affected the chances of WAIKEEPADACASH. The evidence of Mr Cooksley was quite definite that it cost him ground and a better place and he said he had been able to recover ground lost in the incident to get within half a length of the third horse. In our opinion that evidence is supported by the video and we are satisfied that the chances of WAIKEEPADACASH have been affected. We also have a discretion in these circumstances as to whether to exercise the right to relegate and we are satisfied on that given the critical stage of the race that the discretion ought to be exercised and we therefore uphold the protest and the placings will now be amended as follows:
