Charge:
Following the running of race 7 an information was filed pursuant to rule 638(2). The informant, Mr Oatham, alleged that Mr Bosson, the rider of RUUD AWAKENING, made a celebratory gesture prior to passing the winning post.
Facts:
Mr Oatham demonstrated on the video films Mr Bosson made a victory salute one and a half strides before the finish. He added it was not the worst celebratory gesture.
Mr Bosson told the Committee he made an error of judgement as he thought he had past the post.

Mr Oatham told the Committee this was Mr Bosson's 2nd breach under the rule this week, noting both were in Group 1 races. He said the Rule was in place for safety reasons and submitted an increase on the $300 imposed on Wednesday was appropriate.

The Committee carefully considered all the evidence and submissions presented. The mitigating factors are Mr Bosson's admission of the breach and we assess the celebratory gesture to be at the low end. However, the aggravating fact this was Mr Bosson's second celebratory gesture breach for the week. We note that prior to this week Mr Bosson did have a clear record under this rule. We are of the view a small increase from Wednesday's penalty is warranted.
