Having regard for this Rule the Committee disqualified SUPACALIFRAGLISTIC from its 7th placing.
Facts:
Following race 4 an information was filed pursuant to Rule 618(2).The informant, Mr Oatham, Request for a Ruling alleging that SUPACALIFRAGLISTIC started in this race carrying the incorrect weight due to Mr Dee claiming an incorrect apprentice allowance.
Mr Oatham read the rule and Mr Dee acknowledged that he understood it.
Submissions for Decision:
Mr Oatham informed the Committee that it was established that Apprentice Mr Dee, was entitled to claim a 3kg allowance had been weighed out with a 4kg allowance. Therefore the Stewards submission was the horse should be disqualified from the race. He said Ms Tanner, the trainer of SUPACALIFRAGLISTIC, acknowledged her horse had weighed in light and did not wish to contest the Ruling. Ms Tanner also did not wish to be present at the hearing.
Mr Dee, in the presence of Mr P Shailer, advised the Committee that he was instructed to remove 1kg of lead by the Clerk of Scales at the time of weighing out. Mr Dee confirmed to the Committee he weighed in light by approximately 1.5kgs.
Mr Oatham confirmed that Mr Sanders, Clerk of Scales, had made an error as he thought Mr Dee was a 4kg claimer when he was only a 3kg claimer.
Reasons for Decision:
The Committee carefully considered all the submissions presented. We note that Ms Tanner the trainer of SUPACALIFRAGLISTIC did not wish to contest the Request for a Ruling. Mr Dee confirmed he did weigh in light. We referred to this particular Rule which confirmed any horse with an incorrect weight or weight allowance be disqualified for the race by the Judicial Committee.
We note SUPACALIFRAGLISTIC was unplaced in the race.
