As the breach was admitted we find the charge proved.
Penalty:
Without the mitigating factors above this charge would warrant a suspension of 6 days. However taking those factors into account we believe a 1 day reduction is appropriate. Therefore we suspend Miss Spratt from riding in races which is to start after racing on 12 March and conclude after racing on 19 March 2011 (5 days).

Facts:
Following race 1 the informant Mr C George alleged that Miss Spratt permitted her mount POSTAGE to shift outwards near the 300 metres when not sufficiently clear of GALLIVANT ( L Innes) which was checked.
Submissions for Decision:
Mr Oatham demonstrated the video films which showed POSTAGE ridden by Miss Spratt racing in a 3 wide position approaching the 300 metres. At that point Miss Spratt angled her mount out to obtain clear running and in doing so moved into the line of GALLIVANT when insufficiently clear. This resulted in Mr Innes having to check his mount sharply.
Miss Spratt while admitting the breach said that Mr Innes had also angled out but was being held in by NUKUMAI on its outside. She admitted she ducked out but believed NUKUMAI played a part in the interference.

Mr George submitted Miss Spratt's record which showed only one careless riding charge in the last 12 months. He said in this case her carelessness was in the mid range with the check to GALLIVANT quite a severe one. Miss Spratt said she had commitments up to and including 12 March 2011 and did ride in the South Island when possible.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. While the committee concedes that NUKUMAI was trying to hold GALLIVANT in we are firmly of the view he did not shift ground inwards at any stage. Therefore the severe check to Mr Innes was caused solely by the outward movemewnt of Miss Spratt. The mitigating facts in this charge are Miss Spratt's very good record and her admission of the breach.
