As Mrs Satherley admitted the breach the Committee found the charge proved.

Penalty:

Accordingly, Mrs Satherley had her license to ride in races suspended for a period to commence after racing on 9 December and conclude after racing on 20 December 2017 (6 National riding days).

Facts:

Following the running of race 3,  JR Webb, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Williamson, alleged that Mrs Satherley permitted her mount CAESOUR’S DREAM to shift out when not sufficiently clear of PRINCESS KERERU which was checked near the 250 metres.

Mrs Satherley acknowledged that she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Coles demonstrated the incident using the available video footage. He identified that Mrs Satherley allowed her mount to shift out near the 250 metre mark when only a bare length clear of PRINCESS KERERU. In doing so that runner was checked, lost momentum and was denied the opportunity of finishing in a better placing. He said that Mrs Satherley misjudged the outward manoeuvre and the check was not severe.

Mrs Satherley said she misjudged the outward shift and the carelessness was minor.

Submissions for Penalty:

Mr Williamson produced Mrs Satherley’s record which showed no previous breaches under this Rule in the last 12 months. He said that Mrs Satherley has a good record and she admitted the breach at the first opportunity. He added that the interference to PRINCESS KERERU certainly cost that horse a better placing and described the overall level of carelessness as mid-range.

Mrs Satherley advised that she had no upcoming engagements in the next 7 days and any proposed suspension could start immediately.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

When reviewing the video footage the Committee observed that Mrs Satherley did look to her outside prior to commencing an outward shift however she did misjudge the distance between her mount and PRINCESS KERERU. She shifted out 1 horse width and took the rightful running line of PRINCESS KERERU which we deemed cost that runner a better placing and resulted in a protest which was upheld. Taking those factors into account we assess the totality of the carelessness as mid-range.

The Penalty Guide for Judicial Committees recommends that the starting point for mid-range carelessness is 8 National riding days.

The mitigating factors were Mrs Satherley’s admission of the breach and her excellent record. For these collective factors we afforded her a 2 day reduction.
