Following Race 3 an Information was filed pursuant to Rule 616 (1). The Informant, Mr Oatham, alleged that Mr S Wenn, trainer of LA MONTOYA, failed to advise the Stewards of notifiable gear.

Following Race 3 an Information was filed pursuant to Rule 616 (1). The Informant, Mr Oatham, alleged that Mr S Wenn, trainer of LA MONTOYA, failed to advise the Stewards of notifiable gear.
--Mr Wenn admitted the breach.
--Mr Oatham explained that this was LA MONTOYA’S first start and had been trialing in blinkers but it was Mr Wenn’s responsibility to notify stewards of the addition of blinkers on race day. He conceded there was no intent on Mr Wenn’s part to deceive the stewards and this was purely an oversight.
--Mr Wenn said the horse had always trialed and worked in blinkers and this was simply an oversight on his part.
--PENALTY SUBMISSIONS
--Mr Oatham submitted that, as it was Mr Wenn’s first charge and he had pleaded guilty, a fine in the range of $150 - $250 would be appropriate.

--The Committee considered all the evidence and submissions as presented. In mitigation we have considered Mr Wenn’s guilty plea and that this was his first charge under this rule.
--Accordingly we impose a fine of $175.
