Facts:
Following race 10 an information was filed pursuant to rule 638 (3) (b). Mr Neal submitted that Mr C Dell used his whip excessively prior to the 200 metres.
Submissions for Decision:
Mr Neal demonstrated the video films and pointed out to the committee Mr Dell striking his mount approximately 12 times before the 200 metres without giving the required respite.
Mr Dell in admitting the breach explained that the conditons were very difficult making his goggles muddy and restricting his vision. He said the 200 metre mark on the outside of the track was difficult to see.
Mr Vance submitted that Mr Dell's record with only 1 whip charge in 3 years was a very good one and asked the committee to consider this.

Mr Neal said that Mr Dell had a clear whip record in the last 12 months and said that today's breach was at the low end.
Mr Dell had nothing further to say regarding penalty.

The committee considered all the evidence and submissions as presented. In Mr Dell's favour are his clear record in the last 12 months and his admission of the breach. However any excessive whip charge is viewed seriously because of the animal welfare issues at stake.
