Facts:
Following race 10 an information was filed pursuant to rule 638(3)(b). Mr Neal alleged that Mr A Forbes used his whip excessively prior to the 200 metres.
Submissions for Decision:
Mr Neal demonstrated the video films pointing out Mr Forbes striking his mount approximately 12 times before the 200 metres. He submitted Mr Forbes had not given his mount the required respite.
Mr Forbes in admitting the breach explained to the committee he had come from a long way back and was giving his mount which was the favourite every chance in the heavy ground.
Mr Vance in support of Mr Forbes submitted that it was more of a brushing of the whip rather than one of striking. He said in his opinion the number amounted to 8 not 12.

Mr Neal submitted that Mr Forbes had a clear whip record in the preceeding 12 months and believed today's transgression was at the low end.
Mr Forbes had nothing to add regarding penalty.
Reasons for Penalty:
The committee considered the submissions and evidence as presented. Mitigating factors are Mr Forbes' clear record and his admission of the breach. It was also explained to Mr Forbes that animal welfare is of paramount importance which all jockeys must be aware of.
