Information 6541 alleged a breach of Rule 871(1)(d) by Mrs T Thornton the rider of CROSSWISE in that she angled her mount outwards when not sufficiently clear making firm contact with KAPRAAD (L Cheshire).

The breach was not admitted.

Miss Cheshire stated that the incident occurred as CROSSWISE came from a position off the rail at the top of the straight and took her line with only about a head clearance. She had been travelling well at the time but had no chance after the check. It had, she said, been quite a hard knock and although her horse had not much size it had been going good enough to hold CROSSWISE in beforehand. She had yelled but by then the incident had occurred.

Stipendiary Steward Mr J Oatham, demonstrated the incident on video and noted that Mrs Thornton had angled outwards to make solid contact on to Miss Cheshire's mount and thus had created a gap for herself where there had been no gap before. He noted a movement by Mr C Grylls but suggested this was after the outward movement was initiated by Mrs Thornton.

Mrs Thornton said that while there had been an outward movement it was not the result of any deliberate act on her part. CROSSWISE had got keen to improve and just shot off and made contact of his own accord. She described him as a big baby, it was his first start and he was just green and raced awkwardly causing the contact before she could take hold and it had nearly unseated her. She believed she had done her best throughout on a green horse and did not accept she was careless.

Mr McCutcheon acknowledged the horse was green but said the film was clear that CROSSWISE had been angled out despite what Mrs Thornton said.

The Committee found that the evidence from Miss Cheshire and Mr Oatham was clear and despite what Mrs Thornton said it believes the video supports that evidence and she did angle out. As a result she failed to discharge her responsibility in the circumstances and the breach was established.

In assessing penalty Mr McCutcheon confirmed that Mrs Thornton had been suspended for three days in December 2005 and this was the only item on her record for the last 12 months. It was a very good record, there were mitigating circumstances given the horse racing greenly, but nevertheless he thought a suspension ought to be imposed.

--

The Committee after taking all these matters into consideration ordered that suspension be imposed from the conclusion of racing on 11 March 2006 until the conclusion of racing on 18 March 2006, a three-day suspension involving Matamata, Wanganui and Te Rapa meetings.
