--This is a protest by Stipendiary Steward Mr AR Coles alleging that SWEET CHARIOT (L Callaway) or its rider placed second by the judge interfered with the chances of ELEMENTARY (A Calder) in the final straight.
--The connections of SWEET CHARIOT were represented by its trainer, Jenny Scott, and those of ELEMENTARY by its trainer, Russell Cameron. The right to charge was reserved by Mr Coles.
--Jockey A Calder confirmed that he had suffered interference while trailing SWEET CHARIOT as they commenced the run in the straight. There was a gap of a width and a half on the inside, which tightened sharply on him as he was attempting to improve costing him momentum and he estimated a distance of one to two lengths. He believed his chances were affected because of the margin of a head between third and fourth.
--Stipendiary Steward J Oatham demonstrated the incident on video identifying the runners and showing from three different views how the gap had tightened and the resulting interference to ELEMENTARY.
--Mrs Scott pointed out that although SWEET CHARIOT had caused tightening as alleged she believed it was always going better and despite the opportunity to recover for the balance of the run home ELEMENTARY had not closed the distance and lost third at the last stage of the race when weakening and allowing an improving horse to come up and take third.
--Mr Coles in summing up said it was for the committee to decide whether the chances of ELEMENTARY were affected. There was no doubt it had suffered interference and it had lost third by a head after losing more than that from the interference at the top of the straight.
--The Committee having considered all the evidence and viewing the videos finds this interference has occurred as alleged which resulted in ELEMENTARY losing one to two lengths in the incident. After that the videos show no apparent regaining of the lost ground in the run to the finish and it accepts the evidence of Mrs Scott supported by the video, that third placing was lost in the final 50 metres by ELEMENTARY coming to the end of its run as it was overtaken by GIMMEE D?CASH running into third placing by a head. On that basis it is not satisfied that the chances of ELEMENTARY were affected and accordingly the protest is dismissed and the Judge's placings stand.
