As Mr Harris admitted the breach the Committee found the charge proved.

Penalty:

Accordingly, Mr Harris was fined the sum of $300.

Facts:

Prior to the running of race 9, Bunnings Tarde 1400, an Information was filed pursuant to Rule 330 (3)(c). The Informant, Mr Oatham, alleged that Mr Harris failed to make the contracted weight for TRANSFORMER.

Mr Harris acknowledged that he understood the Rule and admitted the breach.

Rule 330(3)(c) provides: “A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.

Mr Oatham advised that Mr Harris was unable to make the contracted weight of 58.5 kgs. He said that Mr Lammas was the replacement rider of TRANSFORMER.

Mr Harris said that he was struggling with his weight at present.

Submissions for Penalty:

Mr Oatham said that Mr Harris had breached this Rule on 16 August, 6 October and under the Minor Infringement Schedule was fined $100 and $200. He said that Mr Harris has recently made a comeback to race riding and he has to clearly get his weight under control. He said the Stewards would not be wanting to see Mr Harris in the near future. Mr Oatham submitted a fine in the $200 to $300 range.

Mr Harris accepted Mr Oatham’s submissions.

The Committee carefully considered all the evidence and submissions presented.

Mr Harris has appeared before the Judicial Committee because he breached the overweight Rule for the third time within a 120 day period.

It is clear that Mr Harris is having trouble with this weight. The Committee reminded Mr Harris that it was important for him to inform his Agent the current situation with his weight.

The only mitigating fact was Mr Harris’ admission of the breach.

The Committee had regard for similar breaches of this Rule when determining an appropriate penalty.
