Accordingly, pursuant to Rule 632 the Committee exercised its discretion and declared CINEMATIC to be a non –starter.

The Committee ordered dividends and stakes to be paid in accordance with this decision.

Facts:

Following the running of Race 3, Ideal Electrical Legrand 1200, Mr R Collett, Trainer of CINEMATIC, lodged an Information requesting a ruling in relation to Rule 632 to establish whether CINEMATIC was denied a fair start.

Rule 632 provides “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placing’s was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”

Submissions for Decision:

Mr Collett said that the films showed that the Barrier Attendant was still holding onto CINEMATIC when the gates opened. He said as a consequence CINEMATIC was on the back foot and his horse lost 2 lengths.

Ms Collett said that the Barrier Attendant had a hold of CINEMATIC when the gates opened. She said that resulted in her horse jumping awkwardly losing 2 lengths.

Mr Harrison said that it was clear that CINEMATIC jumped awkwardly and lost about 2 lengths. He said that the Barrier Attendant admitted that he had a hold of CINEMATIC’S rein when the gates opened.

Mr Oatham submitted that the Barrier Attendant still had a hold of CINEMATIC when the gates opened. He said it was clear that CINEMATIC had its head turned sideways when the gates opened and the horse lost 2 lengths. He was of the view that CINEMATIC was denied a fair start.

Reasons for Decision:

The Committee carefully considered the submissions presented and reviewed the video footage.

It was evident that when the gates opened the Barrier Attendant still had a hold of CINEMATIC’S right rein and in doing so the horse's head was turned sideways. This resulted in CINEMATIC jumping awkwardly and losing approximately 2 lengths. In our opinion it was clear that CINEMATIC was denied a fair start.

The Committee notes that NZTR Starters Manual Policy provides: 6.21 Barrier Attendants at the Jump: If still in the starting gates or alongside horses, Barrier Attendants shall immediately release any hold they may have of a horse as the gates commence to open. Barrier Attendants shall not hit a horse as it leaves the barriers or in any way attempt to provide additional assistance to a horse as it jumps.
