Information 7779 alleged a breach of Rule 871(1)(d) in race two by jockey O P Bosson for shifting outwards on STAR OF MULWALA when not sufficiently clear of GENERATED (D Hain) who had to be checked. The breach was not admitted.

Apprentice jockey D Hain confirmed that he had suffered interference 300 metres from the finish when Mr Bosson's mount shifted outwards approximately 1 ? 2 horse widths when no more than one length ahead. He was obliged to take hold for about four strides to check off the heels of Mr Bosson's mount, and he agreed he had a clear run before the incident.

Stipendiary Steward J P Oatham demonstrated the incident on the videos confirming the outward movement and the reaction of Mr Hain by turning away the head of GENERATED and taking hold. He described the movement out as "quite sharp" and although Mr Bosson was riding forward he took GENERATED?S line of running and it was in danger of clipping heels.

Mr Bosson stated that he had been traveling well prior to angling out and was himself in danger of clipping heels if he had not moved out.

Summing up Mr Coles submitted the evidence was clear and pointed out Mr Bosson could have checked off in the first instance rather than electing to angle out.

The Committee after considering all the evidence is satisfied a braech has occurred as alleged. It does not accept Mr Bosson's basis for denying any breach and agrees with Mr Coles' submissions.

In considering the penalty Mr Coles asked the Committee to note that Mr Bosson's record included suspensions at Hastings in September and October and he had recently been suspended for three days at Avondale. On the other hand he was a busy rider taking engagements throughout the country. He asked that a suspension be imposed.

Mr Bosson asked for deferment of any suspension to allow him to ride at Riccarton where he was to ride NATURO in the 1000 Guineas on the first day and had a full book of rides for both days. He understood there might be some difficulty in finding replacements at this stage. The Committee took this into account but was not satisfied there was sufficient evidence to justify a deferment. Accordingly it ordered suspension to take effect from the conclusion of racing on 8 November until the conclusion of racing on 14 November next. In doing so it was considered that a suspension on a Premier day was the equivalent of a two day suspension and therefore the three days here comprising Riccarton, Tauherenikau and Otaki, were the equivalent of a four day suspension in other circumstances.
