As Mrs Allpress admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted Mrs Allpress a deferment pursuant to Rule 1106(2). Accordingly, her licence to ride in races is suspended for a period of 3 days commencing after racing on 11 March 2021 and concluding after racing on 14 March 2021. In addition, we impose a $500 fine.

Facts:

This charge arises from the running of Race 6, the Vertical Logistic 1400. Chief Stipendiary Steward, Mr Oatham filed an Information pursuant to Rule 638(1)(d) alleging the rider of ROCH ‘N’ HORSE (L Allpress) allowed her mount to shift in when not sufficiently clear of MAI TAI which was checked passing the 50 metres.

Mrs Allpress acknowledged she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Using the available race films Senior Stipendiary Steward, Mr Williamson demonstrated the incident and identified the horses and riders concerned; namely ROCH ‘N’ HORSE (L Allpress), SUPER PURSUIT (A Calder) and MAI TAI (O Bosson).

Mr Williamson told the Committee that early in the home straight MAI TAI and ROCH ‘N’ HORSE bumped when MAI TAI was attempting a run on the inside of ROCH ‘N’ HORSE. He said that nearing the 100-metre mark ROCH ‘N’ HORSE was mounting a run on the outer of SUPER PURSUIT. At the same time a gap emerged, and a run developed for MAI TAI due to SUPER PURSUIT laying inwards. At this stage MAI TAI was a neck to half a length behind ROCH ‘N’ HORSE who commenced shift inwards closing the gap. As a result, from the 50-metre mark Mr Bosson had to take a hold of his mount and finished in fifth place. Mr Williamson said that ROCH ‘N’ HORSE shifted in about two horse widths and it is highly likely that the shift cost MAI TAI the opportunity of finishing in a better position.

In response Mrs Allpress agreed with the Stewards' assessment. She said that she knew her horse had shifted in whilst under pressure and she tried to take corrective action, but it was too late.

Submissions for Penalty:

Mr Oatham said that Mrs Allpress has a clear riding record under the Careless Riding Rule. He said that in the last 12 months (or more) she has over 420 race day rides without breaching the Rule. He said that her record was therefore excellent given she is a busy senior rider.

Mr Oatham said Stewards assessed the level of carelessness to be in mid-range because MAI TAI was potentially denied the opportunity to finish in a better placing.

Mrs Allpress initially sought a deferment to any proposed suspension until after racing on 11 March 2021, but after checking her immediate engagements sought to commence her suspension after racing on 12 March 2021. In relation to penalty, she submitted that her good record should be considered as well as the fact that she made a genuine effort to straighten her mount.

Reasons for Penalty:

After considering the submissions and reviewing the race films and the Committee determined Mrs Allpress’ carelessness to be at the lower end of mid-range and adopted a 5-day (suspension) and $500 (fine) as the starting point. This conforms with the Penalty Guide starting point for mid-range-range carelessness.

The head and side-on race films clearly established that Mrs Allpress permitted her mount to drift inwards when racing under pressure over the concluding stages of the race. The inward drift was not abrupt, and she made some effort to straighten her mount. It is accepted that MAI TAI was presented for and denied a run between ROCH ‘N’ HORSE and SUPER PURSUIT. MAI TAI and a ROCH ‘N’ HORSE finished in 5th and 2nd placings, respectively. There was a narrow margin between the 3rd, 4th and 5th placed horses and we understand that the connections did consider lodging a protest, but after viewing the race films did not pursue that option.

Mrs Allpress’ riding record was assessed as excellent. It is noteworthy that her previous breach of the Careless Riding Rule occurred in November 2019. Notwithstanding she has had some time off due to COVID and recovery from injury, it is to her credit that it is 16 months since she last breached the Rule, particularly so given that she is regarded as a busy national rider. On that basis for her admission of the breach and excellent record we apply a 2-day reduction from the starting point. This is consistent with the approach taken with other busy riders who have maintained a clear record over an extended period. It also conforms with uplifts applied to riders who have poor records and demonstrates that credit will be given to those riders who maintain an unblemished record over an extended period of time.

After considering and weighing up the above factors the Committee deemed a suspension of 3 (national) days and $500 fine to be appropriate under the circumstances.
